(2) These GTC apply to both consumers and businesses unless expressly stated otherwise.
(3) Any deviating terms and conditions of customers shall not apply unless expressly confirmed in writing by the Provider.

3. Subject Matter of the Contract
(1) The online shop offers, in particular: Individual issues of the P.IN.E.A magazine, Memberships, Merchandise products, Art editions
(2) The specific scope of services is defined in the respective product description.
4. Conclusion of Contract
(1) Product presentations in the online shop do not constitute a legally binding offer.
(2) By completing the ordering process, the customer submits a binding offer to conclude a contract.
(3) The contract is concluded upon acceptance by the Provider or upon shipment/provision of the ordered goods or services.
(4) Automated order confirmations do not constitute acceptance of the offer.
5. Prices and Payment
(1) The prices displayed at the time of ordering shall apply.
(2) Payment shall be made using the payment methods offered in the online shop (e.g. credit card, PayPal, Klarna, EPS).
(3) Prices include statutory VAT where applicable.
(4) Payment is due immediately upon conclusion of the contract.
(5) Default interest shall accrue at a rate of 8% per annum.
(6) During any period of payment default, Members shall not be entitled to Membership benefits.
6. Delivery and Shipping
(1) Goods are shipped from Vienna, Austria.
(2) Deliveries are generally available worldwide. The Provider reserves the right to exclude certain countries or regions for logistical, legal, or economic reasons.
(3) Delivery times are non-binding unless expressly agreed otherwise.
(4) Customs duties, import taxes, and any other charges in the destination country shall be borne by the customer.
7. Retention of Title
Goods shall remain the property of the Provider until full payment has been received.
8. Individual Issues
(1) Individual issues are sold as one-time purchase products.
(2) Publication dates may be subject to change.
9. Memberships
(1) Memberships are personal and non-transferable.
(2) The conclusion of a Membership agreement does not establish membership in the association “Fotografie im Diskurs” and does not give rise to any rights or obligations under association law.
(3) Membership benefits include, in particular: Two printed issues per calendar year; Access to digital content; Access to events.
(4) Content and services may be further developed, provided that the overall nature of the Membership is preserved.
(5) Access is linked to a specific e-mail address and may not be shared with third parties.
(6) Memberships automatically renew for an additional one-year term unless cancelled in writing by 31 December of the current year.
(7) Timely cancellation shall be determined by the date of receipt of the cancellation notice.
(8) Prices and conditions shall be governed by the current price list.
10. Membership Plus
(1) Member Plus Membership includes all benefits of a regular Membership.
(2) In addition, Member Plus Members receive discounts and pre-sale rights for P.IN.E.A Editions.
(3) Member Plus Members may also apply for admission as extraordinary members of the non-profit association “Fotografie im Diskurs”.
(4) The purchase of a Membership Plus does not automatically entitle the purchaser to admission to the Association. The application for Association membership is submitted upon purchase of the Membership Plus. Admission, however, shall be granted solely in accordance with the Association’s bylaws. An application may be rejected without stating any reasons.
(5) Extraordinary members do not have voting rights at the General Assembly.
(6) Participation in the annual “P.IN.E.A Think Tank” (the General Assembly of the association Fotografie im Diskurs) is permitted.
(7) The association statutes shall apply in addition to these GTC.
(8) Association membership shall end no later than the expiration of the Membership Plus unless continued separately by the association.
(9) Memberships Plus automatically renew for an additional one-year term unless cancelled in writing by 31 December of the current year.
(10) Timely cancellation shall be determined by the date of receipt of the cancellation notice.
(11) Prices and conditions shall be governed by the current price list.
11. Digital Content (Member Login)
(1) Access to digital content is provided through the website.
(2) Login credentials must be kept confidential.
(3) Misuse may result in suspension or termination of access.
12. Merchandise Products
(1) Merchandise includes physical products such as bags and similar items.
(2) Minor deviations customary in trade shall not constitute defects.
13. Art Editions
(1) Art Editions are limited, curated, or artistic works (e.g. editioned prints or unique works).
(2) Editions may be numbered and/or signed.
(3) Reproductions shall only be made where expressly indicated.
(4) Art Editions may only be used for private purposes. Any commercial use requires the consent of the respective rights holders.
(5) Information about the artworks is provided on the basis of information supplied by galleries, art associations, and artists. P.IN.E.A will verify such information to the extent reasonably possible and accepts only limited liability for its accuracy.
(6) Works of art, particularly photographs, are subject to environmental influences. Their appearance and colors may change or fade over time. P.IN.E.A does not provide any warranty with respect to such natural aging or deterioration.
(7) The warranty does not cover damage resulting from normal wear and tear, improper use, inadequate or incorrect care, or improper storage.
(8) With respect to editions, minor variations in color and size compared to the images displayed online are possible. Warranty claims based on such minor deviations are excluded.
(9) All artworks (including, but not limited to, photographs, prints, mounted works, and similar items) must not be exposed, in whole or in part, to direct sunlight, hung directly above radiators or other heat sources, or exposed to humidity exceeding normal residential conditions. Accordingly, artworks are not suitable for outdoor use, basements, bathrooms, or kitchens. Mounted works with UV-protective film or acrylic glass, as well as wooden frames, are highly susceptible to scratches and stains and should therefore only be handled while wearing gloves or with comparable protective measures.
14. Right of Withdrawal
(1) Consumers are entitled to a statutory right of withdrawal.
(2) Details are set out in the Withdrawal Policy.
(3) In the case of Memberships (which include, among other things, digital content), the right of withdrawal expires upon the early commencement of the services. Consumers expressly consent to the provision of digital content before the expiration of the withdrawal period and acknowledge that, as a result, they lose their right of withdrawal with respect to the Membership.
15. Warranty
(1) Statutory warranty rights shall apply.
(2) For business customers, the warranty period shall be limited to twelve months.
16. Liability
(1) The Provider shall be liable only for intent and gross negligence. Compensation shall be limited to direct damages; loss of profit shall not be recoverable.
(2) In cases of slight negligence, liability shall be limited to breaches of essential contractual obligations and to foreseeable, typical damages.
(3) The limitation period for damages claims shall be one year.
17. Copyright
All content is protected by copyright.
Any use beyond the scope permitted by applicable copyright law requires prior written consent.
18. Data Protection
The Privacy Policy available on the website shall apply.
19. Governing Law and Jurisdiction
(1) Austrian law shall apply, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG).
(2) Consumers retain any mandatory consumer protection rights granted by the laws of their country of residence.
(3) For business customers, the exclusive place of jurisdiction shall be Vienna, Austria.

20. Final Provisions
Should any provision of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
